These terms govern your use of the Fretfire software and the fretfire.app website. By downloading, installing, or using Fretfire, you agree to these terms.

Fretfire Lite is free to use under a personal, non-commercial license. It is distributed via the Mac App Store and is also subject to Apple's standard EULA.

Fretfire Pro: upon valid purchase and activation with a License Key, we grant you a personal, non-exclusive, non-transferable, perpetual license to use Fretfire Pro on up to 3 (three) machines that you own or control.

4. Intellectual Property

5. Payment and Delivery

Fretfire Pro is sold as a one-time purchase at the price displayed at checkout. All payments are processed by LemonSqueezy, our merchant of record. By completing a purchase you also agree to LemonSqueezy's Terms of Service.

Upon successful payment, you will receive a License Key and a download link for the Fretfire Pro installer (.dmg) via email. Prices are displayed in USD and may be subject to applicable taxes as determined by LemonSqueezy based on your location.

6. Refund Policy

We offer a 30-day money-back guarantee from the date of purchase. To request a refund, contact us at [TODO: support email address] or submit a request through LemonSqueezy. Refunds are processed by LemonSqueezy, and your License Key will be deactivated upon refund.

7. Updates and Support

Your Pro license includes all updates to Fretfire Pro within the same major version. We are under no obligation to provide updates, but may do so at our discretion. Support is provided on a best-effort basis via the support page.

8. Disclaimer of Warranties

The Software is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Software will be error-free, uninterrupted, or compatible with all hardware or software configurations. Audio analysis results — including chord detection and stem separation — are generated by machine learning models and may not be perfectly accurate.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall [TODO: Legal entity name] be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Software.

This license is effective until terminated. We may terminate your license immediately if you breach any term of this agreement. Upon termination you must cease all use of the Software and destroy all copies in your possession.

The provisions regarding Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law survive any termination of this agreement.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

If you are a consumer residing in the European Union, you retain any mandatory consumer protection rights granted by the law of your country of residence that cannot be waived by contract.
